First. That Camp was not the guardian of appellant, the will of his father not appointing him guardian. Peyton v. Smith, 2 Dev. & Bat. Eq. 325. Secondly. That there is no proof admissible against the appellees, that at the time of the contract for the land in August, 1843, Camp was indebted to appellant at all; and if there were such proof, it cannot be heard by the court for want of an allegation in the bill of the existence of such indebtedness at that time, the only averment in the bill being that at the time of his death, which the bill avers took place in October, 1845, more than two years thereafter, he was so indebted.
